पढ़िए भारतीय सविंधान पे क्यों हर भारतीय को गर्व करना चाहिए

26 जनवरी 1950 से हमारा सविधान देशभर में लागू हुआ . तब से लेकर आज तक – इसके अनुसार ही देश चल रहा है. इतनी जाति-धर्म होते हुए भी यह दुनिया का सबसे बडा प्रजातंत्र, बिना किसी गतिरोध के प्रगतीपथ पर जा रहा है, इसका श्रेय जाता है केवल हमारे संविधान को.

परन्तु इस संविधान पर हमेशा से ही आक्षेप लगते रहते हैं. उनमें से एक है – कि भारती संविधान ओरिजिनल नही है, बल्कि अन्य घटनांओ की कॉपी मात्र है.

QUORA पर भी यह सवाल पूछा गया था. इस प्रश्न पर दो अलग अलग उत्तर दिए गए – और ये दोनो उत्तर लाजवाब हैं.

पहला उत्तर है तेजस्विता आपटे का.

वह कहती है–

इन जैसे प्रश्नों को ही मै ‘अपमानास्पद’ मानती हूं.
आपको क्या लगता है – संविधान निर्माण करनेवाले जो देश के सबसे होशियार लोग् थे – वो इतने मूर्ख होंगे की अन्य देशों की घटनांए जैसी की तैसी कॉपी कर लेंगे ?

आपको क्या लगता है -हमारा देश पिछले 66 वर्षों में (इमरजेंसी को लेकर) इतना सब कुछ सह कर भी टिका हुआ है, प्रगती कर रहा है – क्या वो एक ‘कॉपी’ किए हुए संविधान के आधार पर?

क्या आपको सचमुच ऐसा लगता है की दुनिया का सबसे बडा प्रजातंत्र, अन्य देशों के संविधान को कॉपी करके बनाई गई घटना के आधार पर केवल तुक्के की वजह से ठीकठाक कार्यान्वित है?

करीब 3 साल तक हमारे संविधान पर चर्चा हुई. संविधान के हर शब्द पर चर्चा हुई. अन्य देशों के संविधानो का अध्ययन हुआ. उन देशों की समस्यांए, वहां की परिस्थितिया और हमारा देश, हमारा समाज इन सब का तुलनात्मक अध्ययन हुआ. इन सब में से सकारात्मक और भारत के लिए लाभदायक ऐसा सब कुछ संविधान में समावेश किया गया.

हर चीज भारत के लिए बदल दी गई, और उसके बाद ही स्वीकृत हुई.

कोई भी अध्ययन किए बगैर ‘ऐसे’ आरोप करना यह अज्ञान जताता है.

अगर थोडी कल्पना चाहिए हो तो एक बात बताती हूं – हमारा संविधान 66 साल से हमारे देश् को दिशा दे रही है. और दुनियाभर के संविधानो की औसत उमर है – 17 वर्ष! इसी से पता चलेगा की संविधान लोगों के लिए अनुकूल ना होता तो क्या होता है.

ये लगा चौका!!

आगे, अनुप कुंभारी ने पूर्णत: भिन्न स्वरूप से उत्तर दिया है :

चक्र का शोध बार बार ना लगाना (मतलब, जो कुछ अच्छा पहले ही ढुंढा गया है, उसे किसी भी संकोच के बिना इस्तेमाल करना) यही समझदार लोगों की निशानी है.

जी हां – भारतीय राज्यघटना यह भारत सरकार अधिनियम, 1935 और अन्य देशों की राज्यघटनांओ की आधार से/ मदद से ही बनायी गई है. लेकिन इसका अर्थ भारतीय राज्यघटना कॉपी की हुई है ऐसा निकाला जा रहा हो तो वह सरासर मूर्खता है.

इसपर मै क्या बोलू? खुद डॉ. बाबासाहेब आंबेडकरजी ने इस आरोप का लाजवाब उत्तर दिया है :

“It is said that there is nothing new in the Draft Constitution, that about half of it has been copied from the Govt. of India Act of 1935 and that the rest of it has been borrowed from the Constitutions of other countries. Very little of it can claim originality.
One likes to ask whether there can be anything new in a Constitution framed at this hour in the history of the world. More than hundred years have rolled over when the first written Constitution was drafted. It has been followed by many countries reducing their Constitutions to writing. What the scope of a Constitution should be has long been settled. Similarly what are the fundamentals of a Constitution are recognized all over the world. Given these facts, all Constitutions in their main provisions must look similar. The only new things, if there can be any, in a Constitution framed so late in the day are the variations made to remove the faults and to accommodate it to the needs of the country. The charge of producing a blind copy of the Constitutions of other countries is based, I am sure, on an inadequate study of the Constitution…
As to the accusation that the Draft Constitution has produced a good part of the provisions of the Govt. of India Act, 1935, I make no apologies. There is nothing to be ashamed of in borrowing. It involves no plagiarism. Nobody holds any patent rights in the fundamental ideas of a Constitution…provisions taken from the Government of India Act, 1935, relate mostly to the details of administration.”

घटनाकार आंबेडकरजी यही पर न रुके! आगे जाकर उन्होंने ‘पूरी तरह से नई राज्यघटना देश के लिए ज्यादा अच्छी होती है क्या?’ इस प्रश्न का भी दमदार उत्तर दिया है :

“I feel, however good a Constitution may be, it is sure to turn out bad because those who are called to work it happen to be a bad lot. However bad a Constitution may be, it may turn out to be good if those who are called to work it, happen to be a good lot. The working of a Constitution does not depend wholly upon the nature of the Constitution.”

मै आगे जाके ऐसा कहूंगा – किसी भी देश को, खुद की राज्यघटना का अंमल करने का अवसर कभी कभार ही मिलता है. अगर इस अवसर का लाभ न उठाया तो आगे जाकर रक्तपात होता है. हमारे देश में अहिंसक मार्ग से राज्यघटना अंमल में आयी और अनेक लोगों को खूनखराबे के बिना समानता का आश्वासन भी मिला.

हमें ‘ग्रेट’ राज्यघटना मिली है.

जब कोई राज्यघटना पर ‘कॉपी’ होने का आरोप लगाएगा – तब उसे यह उत्तर दें!
